HANDICAP TRAVELERS GROUP L.L.C is a Private company owner of  (“HANDICAP TRAVELERS JM”) RENTS THE MOBILITY SCOOTER, WHEELCHAIRS, POWERCHAIR, HOSPITALS ELECTRIC BEDS, WALKERS AIDS, BATH AIDS, PATIENT LIFTS, BABY STROLLER, OR OXYGEN MACHINE (THE “EQUIPMENT”) TO THE RENTER WHOSE NAME APPEARS ABOVE (THE “RENTER”) SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS:


1.1 In order to accept these Terms of Use ( to conclude the contract to use), and be able to access the Services (as defined below) you must click on the appropriate button after declaring your consent to the applicability of These Terms of use and Privacy Policy.



1.2 Handicap Travelers JM send to you to confirmation via an e-mail message, in conjunction with these Conditions of Use and to its privacy policy. When the user receives this e-mail to the indicated purpose by Handicap Travelers DR, the usage agreement will become effective.



1.3 Handicap Travelers JM reserve the right to make, at any time, modify the Conditions of Use and the Privacy Policy. These changes will be communicated through publication on the website www.handicaptravelersjm.com and / or by sending a communication to the email address entered by the user at the time of recording.


Changes and Cancellations

2.1 To change or cancel the reservation verify the terms and conditions applicable to each service as indicated on the website www.handicaptravelersdr.com If you have questions, send an email to info@handicaptravelersjm.com


Non-performance or Operator User.


2.2 Handicap Travelers Group L.L.C is not linked to labor relations of any kind with the Hotel or residence Operators. In case of delay or non-performance of the obligation on the part of Hotel & Resort operators, Handicap Travelers JM is not responsible for the failure occurred.



2.3 Likewise, Handicap Travelers Group LLC is not responsible to the Operator of any User behavior is not consistent with the commitment from these assumptions.

 

Terms & Conditions Cancelation Policies:


Cancellation Plan Handicap Travelers JM.

CPH can be purchased at the time of booking, or within 24 hours of booking if the rental delivery date is more than 30 days out. If CPH is selected, it must be purchased on every rental item. This cost is non-refundable in the event of cancellation. If CPH is not selected, the order is non-refundable.

The cost of CPH per day is $10 USD per rental/item, excluding Portable Oxygen Concentrators, CPAP Machine or Oxygen Tanks (POC/OT).


The cost of CPH for Portable Oxygen Concentrators, CPAP machine or Oxygen Tanks is $20 USD per rental/item.


If CPH is accepted the following applies:

A. If seven (7) or more days’ notice is provided before your scheduled delivery date, you may cancel and receive a refund on your order, minus a one-time $35 USD cancellation fee and the $10 CPH for each rental/item.

B. If notice is given less than seven (7) days before your scheduled delivery date, you may cancel and receive a refund per the following guidelines:


1.For land deliveries, it will be minus a fee equal to 30% of your order, plus the cost  of Delivery fee and Cancellation fee $50 USD for each item (for example if your rental order is $400.00 USD, not including the $10 CPH and Delivery fee then we would hold only $120.00 USD and refund you $280.00 USD which represent 70%).

2. If an order is only partially cancelled, the same guidelines will apply for each cancellation.

3. For on-site event rentals that are cancelled or “shortened” after the event has started, the customer will only be refunded for the days after notice has been given (minus a $75 cancellation fee). The day that the rental is cancelled cannot be refunded.

4. Any cancellation on or after your delivery date is non-refundable.

If CPH is not accepted the following applies:


A. If seven (7) or more days’ notice is provided before your scheduled delivery date, you are entitled to a credit for a future rental, minus a $50 cancellation fee.

B. Any cancellation requested with less than seven (7) days’ notice is non-refundable and no credit will be issued.

C. Event rentals that are cancelled or “shortened” after the event starts are non- refundable.

D. Any cancellation on or after your scheduled delivery date is non-refundable.

LOSS AND DAMAGE

3. The Renter acknowledges that they have fully inspected and accepted the Equipment in good condition and repair. The Renter further acknowledges that the Renter is familiar and knowledgeable with the operation, care, and control of the Equipment and is capable of safely operating the Equipment.


4. The Renter shall return the Equipment at the end of the term in the same condition as received and agrees to be the sole operator of the Equipment and to operate the Equipment in a safe and reasonable manner.


5. In the event of loss or damage of any kind whatsoever to the Equipment, the Renter shall, at the option of Handicap Travelers DR, place the Equipment in good repair, condition, and working order as determined by Handicap Travelers DR (in its sole and absolute discretion), at the Renter’s sole cost and expense or, alternatively, replace the damaged or lost Equipment at the prevailing new market value.


8. The Renter agrees to pay all costs, expenses, and legal fees incurred by Handicap Travelers JM in regaining possession of the Equipment or in enforcing or recovering any damage, losses, or claims against the Renter.

SERVICE

9. Should the Renter experience any problems with the Equipment, the Renter or his/her representative is responsible for contacting Handicap Travelers Team immediately at +1 (829)-778-7125. A representative of Handicap Travelers Team will attempt to resolve any service issues over the phone prior to dispatching equipment to replace the Equipment. Please have your equipment readily available.


10. Should delivery of the Equipment be delayed, or should the Equipment malfunction for reasons other than a result of the negligence, misuse, or damage caused (directly or indirectly) by the Renter, Handicap Travelers DR will make commercially reasonable efforts to provide equipment to replace the Equipment. If replacement of the Equipment is not practical, the Renter shall be refunded a portion of the rental cost as determined by Handicap Travelers JM, acting reasonably.


USE OF EQUIPMENT

 

12. The Renter will use the Equipment in a careful, diligent, and prudent manner and will comply with manufacturer requirements and recommendations respecting the Equipment, and with all applicable laws including, but not limited to, all local, provincial, state, or federal laws respecting the use of the Equipment in JAMAICA.


13. The Renter acknowledges that it shall be the sole operator and occupant of the Equipment and will use the Equipment for the sole purpose for which it was designed and not for any other purpose. The Renter agrees not to make any modifications to the Equipment. There are not to be any additional riders, including children on motorized vehicles.


14. The Renter acknowledges that where the Equipment is taken outside of the service area, as may be designated by Handicap Travelers JM, the Renter will be responsible for any maintenance, repair, or replacement of the Equipment resulting from such actions, as well as any additional delivery or pickup charges that may be incurred by Handicap Travelers JM. Any costs incurred to assist in the maintenance, repair, or replacement of the Equipment outside the service area is the sole responsibility of the Renter.


Exclusion of Handicap Travelers Group LLC responsibilities


12.1 Handicap Travelers Group L.L.C has no responsibility and no duty to take any action and / or an investigation regarding: (i) the identification of Users who access the Web and / or conformity with the true data provided by them at the time of registration; (Ii) the content which the User accesses through the web service; (Iii) the effects of such content on the User; (Iv) the interpretation and / or use of content by the user; (V) the actions that the user can take as a result of exposure to such content.



12.2 Handicap Travelers Group is specifically exempted, with the acceptance of these conditions, any and / or any inherent responsibilities directly and / or indirectly the web service content and content contained in third party sites that the site should eventually target.


12.3 Handicap Travelers Group is specifically exempted, with the acceptance of these conditions, any and / or any related responsibilities, directly and / or indirectly, contacts and constraints arising between users and between users and operators.


Under no circumstances Handicap Travelers Group LLC will be held responsible for any reason whatsoever for damages of any nature arising directly and / or indirectly the relationship between User and Operator or in any case pertaining, directly and / or indirectly Services.


12.4 By way of example, Handicap Travelers Group LLC will not be in any way responsible for damages resulting from damage or breakage of any kind, personal injury, theft, or otherwise for any damage in any way related to the relationship between Users and Operators and / or between them and third parties. Users and operators, in any case, shall employ all necessary precautions in order to prevent the occurrence of such events, also with the utmost care in all interactions with any individual with whom he gets on with the web service.


12.5 Users and Operators expressly acknowledge that the web service is only limited to offering a virtual market place where the supply and demand of services are. Handicap Travelers Group LLC is freed from any obligation towards Users in connection with the performance of the Services. Stops the legal nature of the service offered by operators, it should be noted that any which may arise from the execution of the service, such as, for example, the tax imposed by the fiscal and / or labor law, shall be exclusively borne by the User and Operator from time to time involved.

12.6 In any case, Handicap Travelers Group LLC assumes no liability for: (i) execution - Failure or deformed - by the Operator of the benefit due to the User; (Ii) the compliance and accuracy of the services provided by the Operator; (Iii) the damage that for any reason the User is deemed to have suffered following the execution or non-execution or improper execution of the performance by the Operator.


12.7 Notwithstanding the foregoing, it expressly assumes the responsibility to ensure that the environment in which the operator performs the service is free of hazards and / or potential sources of damage to the operator itself. Handicap Travelers Group is not liable for any damage caused to the Operator or to goods and / or the User's personal injuries arising from the presence of such hazards and / or sources of damage.


12.8 For any reporting about the wrongfulness of conduct and / or content, the user can send a message to the email address info@Handicaptravelersjm.com reporting details of the problem.

 

Modification and replacement of the Conditions of Use and suspension of the web service.


13.1 These Terms of Use may be modified or replaced at the sole discretion of Handicap Travelers DR, as well as the web service shall be temporarily suspended or modified for Handicap Travelers DR , Decision at any time, with prior publication of the appropriate notice www.handicaptravelersjm.com site where recipients effect prohibited by the users of the web service, and / or by means of communication to email given when registering to the web service, where targets specific users.



13.2 Handicap Travelers Group may also impose limits on certain features and services or restrict your access to parts or the entire service without prior notice or liability. Governing Law and Jurisdiction

14.1 These Terms of Use are governed by Jamaica law. Any disputes concerning the interpretation, application and / or execution of these Terms of Use as well as all activities governed by the same shall be taken exclusively to the court of Montego Bay in Jamaica.


SEVERABILITY

14.2 If any part of this Agreement be declared or held invalid or unenforceable for any reason, such invalidity or unenforceability shall not affect the validity and enforceability of the remainder, which shall continue in force and effect and be construed as if this Agreement had been executed without the invalid or unenforceable portion and it is hereby declared the intention of the parties hereto that this Agreement would have been executed without reference to any portion which may, for any reason, be hereafter declared or held invalid or unenforceable.


ENTIRE AGREEMENT

14.3 This Agreement constitutes the entire agreement between Handicap Travelers JM and the Renter.

This Agreement shall not be amended, altered, or changed except by a written agreement signed by Handicap Travelers Group LLC and the Renter.
